IP Monitoring

IP Monitoring Services

A trademark owner has the responsibility to monitor, enforce and police their registered trademark(s). Enforcing your trademark may be critical to protect your company’s or your product’s reputation and goodwill. Failure to do so can lead to a narrowing of your rights with the mark, even possibly losing your trademark rights.

Just because you own a federal trademark registration does not mean that others may also be able to obtain a registration for a closely similar word, logo, or design. Sometimes, entities are able to obtain a federal trademark registration that you may believe is too similar to your own registration. Though the United States Patent and Trademark Office provides a 30-day publication period to oppose a pending trademark application, many are not monitoring these publications.

Beusse Sanks attorneys can monitor trademark publications for our clients so that they are aware of any closely associated trademark applications to help our clients decide whether to oppose the application or not. If a registered trademark is found, we can also counsel clients on whether to file to cancel the registration or taking all necessary actions. Through our network of foreign attorneys and agents, this service is available outside of the United States as well.

Regarding patents, Beusse Sanks patent attorneys can provide preliminary novelty patent searches with an opinion prior to filing a patent application. Beusse Sanks attorneys are also experienced with providing freedom to operate searches so that our clients understand the “lay of the land” before offering a new product or service.

Beusse Sanks attorneys are available to assist clients with the following:

  • Monitoring Other Entity Trademark Application Filings
Patent to Freedom to Operate searches
    Patent novelty searches
